CES Copyright

Using imagery of Continental Environmental Services Ltd., without valid license or a payment made is considered copyright infringement and entitles Continental Environmental Services Ltd. to compensation for infringing uses. (Copyright Design and Patents Act of 1988).

Our company policy is to protect client confidentiality, whereby our work remains confidential to clients who instruct CES verbally, by text message and, or email communication. We do not advertise our services on any company vans and neither do we advertise who our clients are on our website. References and recommendations are through discreet communication.

Company documentation is protected through copyright, which is listed as part of the CES logo, having the annotation within the logo to show that passing on, or copying the certificate is an infringement of copyright and uncontrolled circulation of certification. Our insurance is only valid on payment of certificates that are issued electronically to the client. Any other copies are un-authorised unless the person or company in possession of these certificates can demonstrate that they have received the certificates through legitimate means. Whereby payment can be demonstrated, directly or indirectly by subcontractors who are part of the supply chain. Any failure in the supply chain to pass on payment to CES is a breach of our Terms and Conditions and statutory rights.

Copyright is detailed within Continental Environmental Services Terms and Conditions, reference on quotes is made to the T&Cs which can be issued as part of the formal tender, quote, or issued on request and publically available to all on the world Wide Web. No other client confidential details are published as to retain the client confidentiality and extended to works or part of works for the principle contractor.

Certificates that hold the CES logo denote the copyright to trade marks embedded within the certificate. Names related to Survey Safe are protected by the International Property Office and The International Bureau of the World Intellectual Property Organisation (WIPO), the international trade mark system to which registration extends to China.

If you are in doubt as to the documents that you are in possession i.e. certification with the CES Copyright logo and Survey Safe Trade Marks you should contact Continental Environmental Services Ltd during normal business hours Monday to Friday 9am to 5pm, or email us so that we can verify your entitlement to hold the certification. We will establish the origin of the client and if payment for the works has been received. If no payment has been made we would seek for you to provide evidence that all copies are destroyed or that the outstanding debt is paid or payment as listed below in the important notes are made.

All photos taken on a clients site remains the property of Continental Environmental Services Ltd., permission is granted by the client as part of the CES consultation agreement whereby photos are to be taken in compliance with ISO 17025 and any variation from the standard would require an agreement of variation to ensure that the term of the standard are maintained.

Your confidentiality is our security in maintaining accountability related document security features through the protection of Copyright and Trade Marks ensuring that all works are correctly undertaken and are covered by our insurance.

Important Notes:

1. Ceasing use of the imagery does not release your company of its responsibility to pay for the imagery already used. As the unauthorised use has already occurred, payment for that benefit is necessary.
2. You may have been unaware that this imagery was subject to license and payments. However, copyright infringement can occur regardless of knowledge or intent. While being unaware of license and payment requirements this is unfortunate, it does not change liability.
3. The unlicensed reproduction by whatever means of the whole or any part of any Image (including but without limitation, electronic use, storage or transmission, artists reference, artists illustration, layout or presentation of images) is strictly forbidden. Any reproduction before payment of the invoice or outside the terms of any licence constitutes an infringement of copyright and also a breach of this. Agreement entitling CES to rescind and claim damages and to exercise all rights and remedies available to it under copyright laws around the world. The Licensee shall indemnify CES in respect of any claims, damages, costs or expenses incurred arising from any reproduction without payment for the material imagery supplied to The Licensee including any claims made by a third party. In addition and without prejudice to CES's other remedies under this Agreement, CES reserves the right to charge and Licensee agrees to pay a fee equal to 10% of the clients contract value of their project for certificates (PDFs) and £396.00 standard Licence fee for use of the Image(s) – Photos (JPEGS).
4. No ownership or copyright in any Image(s) shall pass to Licensee by the issue of the Licence.
5. Any publication right (as defined in the Copyright and Related Rights Regulations 1996) arising from The Licensee's use of any Image shall vest in CES and the Licensee hereby assigns all such rights arising to CES.
6. For any Image(s) reproduced in an editorial manner, or presentation to 3rd parties, the Licensee must include a credit in the form of Photographer's name/Continental Environmental Services adjacent to the Image(s) or in a credits section. For Image(s) used for a feature film, broadcast television or cable production, The Licensee must include a screen credit at the end.
