Survey Safe™ is a specialist business within Continental Environmental Services that provides fully independent verification and advice on managing asbestos, as required by Regulation 4 of Control of Asbestos Regulations (CAR) 2012. This supplements the Health and Safety at Work Act 1974 (HSW Act), requiring the duty holder to manage the asbestos on their premises and ensure that staff and contractors are aware of the asbestos containing materials. Section 3 of the HSW Act contains duties to be observed by employers and the self-employed in respect of people other than their own employees. Whereas section 4 of the HSW Act, stipulates duties for those that have control, influence, or overall responsibility within the work place.
Any works that are planned, or in progress, requires a plan of work or otherwise known as a method statement. There must be some form of evidence that the risk of asbestos has been assessed prior to the work being started. Asbestos awareness training has helped employees to recognise asbestos like materials and stop work until the suspect material has been sampled and identified. This has helped prevent a dangerous situation becoming an accident, although it has created an incident by putting the employees at risk and delay to the project whilst works are suspended.
Survey planning and commissioning the correct type of survey for the work being done is essential to maintaining schedules. The Survey Guide was issued in February of 2010 to clearly identify the roles and responsibilities of those undertaking the surveys and for duty holders and employers to fully understand their liabilities, ensuring that the correct surveys are commissioned.
The Management Surveys within the workplace not only comply with Regulation 4 of CAR 2012, but HSW (Health, Safety and Welfare) Regulations 19926 that requires employers to maintain workplace buildings, so as to protect occupants and workers.
The use of Refurbishment and Demolition surveys are to be used within the building maintenance sector, however many rely on Management Surveys instead of Refurbishment Surveys. For this reason the old terminology of Type 1, Type 2 and Type 3 Surveys were abandoned, as their meaning did not transfer to the correct use and interpretation of the reports. Although the methodology of surveying has not changed the reporting and presentation of the information has, to assist client. Construction (Design and Management) Regulations 19947 (CDM) require the client to pass on information about the state or condition of any premises (including the presence of hazardous materials such as asbestos) to the planning supervisor before any work begins. Therefore any minor or major refurbishment or maintenance that is out of the ordinary will require a Refurbishment Survey. This will also form part of the health and safety file that is available for inspection by any person who needs the information.
Management of Health and Safety at Work Regulations 19995 (the Management Regulations) requires employers and self-employed people to make an assessment of the risks to the health and safety of themselves, employees and people not in their employment, arising out of or in connection with the conduct of their business – and to make appropriate arrangements for protecting those people's health and safety. Any assessment made for the purposes of the Asbestos Regulations will not need to be repeated for the Management Regulations; as the information can be transferred into the Management Plan provide that the priority assessment has been completed by the duty holder.
